Terms & Conditions
1. Introduction and Acceptance of Terms
Welcome to Legalmaster™ ("Legalmaster", "we", "us", "our"). These Terms and Conditions ("Terms") govern your use of our website (www.legalmaster.co.uk) and the legal document preparation services offered therein (the "Services"). Legalmaster is operated by Legalmaster LTD, registered in the UK.
By accessing our website or using our Services, you agree to be bound by these Terms in full. If you disagree with any part of these Terms, you must not use our website or Services. Please read these Terms carefully.
2. Service Description - Document Preparation Only
IMPORTANT: Legalmaster™ provides a legal document preparation service. We use legally sound templates to help you generate documents such as Deed Polls, Tenancy Agreements, and Eviction Notices based on the information you provide.
Legalmaster™ is NOT a law firm and does NOT provide legal advice, legal representation, or legal services beyond document preparation. Our Services are not a substitute for advice from a qualified solicitor or legal professional. Communication with Legalmaster™ does not create a solicitor-client relationship.
While our document templates are prepared to be legally sound, their effectiveness depends entirely on the accuracy and completeness of the information you provide and the manner in which you use them.
3. User Obligations and Responsibilities
You agree to:
- Provide true, accurate, current, and complete information when using our Services.
- Assume full responsibility for the accuracy and completeness of all information you submit for document preparation.
- Use the documents generated through our Services lawfully and for their intended purpose only.
- Independently verify that the generated document is suitable for your specific circumstances and jurisdiction.
- Understand that you are solely responsible for fulfilling any prerequisite legal requirements before using documents prepared by our service. For example, when using an Eviction Notice in England, it is the landlord's sole responsibility to ensure they have complied with all legal prerequisites, such as providing the tenant with valid EPC certificates, Gas Safety Certificates (if applicable), and the current government "How to Rent" guide *before* serving the notice prepared using our Service. Legalmaster™ provides the document template; compliance with procedural requirements is your responsibility.
- Not use our Services for any fraudulent or illegal activity.
4. Orders, Payment, and Delivery
Orders for our Services are placed through our website. Payment must be made at the time of ordering via our secure third-party payment processors. Upon successful payment and completion of the required information, your document(s) will typically be made available for download electronically. Specific delivery details will be provided during the order process.
5. Refunds, Corrections, and Amendments
Due to the nature of our digital document preparation services:
- No Refunds for User Errors: We cannot provide refunds for documents (such as Deed Polls or Tenancy Agreements) where the final document is incorrect due to errors, omissions, or inaccuracies in the information *you* provided during the preparation process. It is your responsibility to double-check all information before finalising your order.
- No Refunds for External Factors: We cannot provide refunds for Tenancy Agreements if the reason for non-use is due to external factors beyond the document itself, such as a tenant deciding not to sign the agreement after it has been correctly prepared based on your instructions.
- Corrections/Amendments: If you notice an error in the information you provided after placing an order, please contact us immediately. While we offer no guarantee, we **may**, at our sole discretion, attempt to assist you with corrections or amendments. This assistance is discretionary and may incur an additional fee. We are under no obligation to make changes once an order is processed based on the information you supplied.
6. Intellectual Property
All content on our website, including text, graphics, logos, and the underlying document templates and software, is the property of Legalmaster LTD or its licensors and is protected by copyright and other intellectual property laws. You may use the documents generated for your personal or business purposes as intended but may not resell, redistribute, or replicate our templates or website content.
7. Disclaimer of Warranties and Limitation of Liability
Our Services and the documents generated are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable UK law, Legalmaster™ disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Legalmaster™ does not warrant that the Services will be error-free, uninterrupted, or that the documents generated will be suitable for every individual circumstance or achieve a specific legal outcome. The responsibility for ensuring suitability rests with you, potentially in consultation with independent legal counsel.
To the maximum extent permitted by law, Legalmaster LTD, its directors, employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:
- The use or inability to use the Service;
- Errors, omissions, or inaccuracies in the information provided by you;
- Your failure to comply with legal prerequisites or procedures when using the documents (such as the EPC/How to Rent example);
- Any consequences arising from a name change facilitated by a Deed Poll prepared using our Service;
- Any consequences, losses, or disputes related to property, tenancies, or evictions arising from the use or misuse of documents prepared using our Service;
- Unauthorised access to or alteration of your transmissions or data;
- Any other matter relating to the Service.
Our total liability to you for any claim arising out of or relating to these Terms or the Services, whether in contract, tort (including negligence), or otherwise, shall be limited to the amount paid by you for the specific Service giving rise to the claim.
Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable UK law.
8. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim, although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.
9. Changes to These Terms
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We will update the "Last Updated" date at the top of these Terms when changes are made. We encourage you to review these Terms periodically.
